Softswitch technologies enable the telecommunications market to open the switching aspect to competition. Softswitch also enables a service provider to bypass the central office and Class 5 and Class 4 switches, which, given their extreme expense, technical complexity, and closed standards have protected monopolistic telcos for decades. Part of the reason so many of the Competitive Local Exchange Carriers (CLECs) of the telecom boom of the late 1990s failed is that they were forced to compete with incumbent carriers by deploying the same expensive switches as the incumbents. The incumbents had the advantage of installed switches that were being depreciated often on 40-year schedules. A later chapter will describe the economic advantages of softswitch over Class 4 or Class 5, but suffice it to say that softswitch is cheaper both in purchase price and operating expenses than the circuit switches. Under the Telecommunications Act of 1996, when CLECs attempted to contract with the incumbents to use incumbent switching facilities under provisions of the Telecommunications Act of 1996, they were met with legal stonewalling tactics by the incumbents. This was followed by outright sabotage by incumbent employees of CLEC equipment colocated in incumbent central offices. The only path to competition in telecommunications markets is for each service provider to own and operate their own switching facilities. Softswitch, given its lower costs of ownership and operation coupled with its distributed architecture, makes it possible for new market entrants to compete favorably with incumbent service providers. Softswitch is disruptive to legacy networks (RBOCS and IXCs) and equipment vendors (makers of PBXs and Class 4 and 5 switches) in that elements of softswitch are cheaper, simpler, smaller, and more convenient to use than their predecessors in the network. This chapter has outlined the potentially disruptive technologies relative to the functions of the network elements that they replace. In a later chapter, this book will address the specifics of how these technologies are disruptive and who is disrupted by their introduction into the network and industry. This leaves the final aspect of the PSTN, access, to be opened for competition. Access, like switching, was to be opened to competition by the Telecommunications Act of 1996. Competitors found the same roadblocks to access thrown up by the incumbents as they did to switching. The ownership of twisted-pair copper by quasi-monopolistic incumbent telcos leaves the vast majority of the network closed to realistic competition. This book will address last mile solutions in a later chapter. Once the last mile issue has been solved, consumers will enjoy true competition in the local loop.
